Ashley has stood in one election in Medway and won that election.

In August 2007, Ashley was found guilty of 21 counts of deception by falsely claiming £65,506 in income support and housing benefit. He was acquitted of a further four charges. Later that month, he was sentenced to nine months in prison. In December 2007, he was ordered to repay £67,000 in falsely claimed benefits.

Ashley had been expelled from Ukip in July 2004, after he was initially charged, but he could only have been disqualified from being an MEP if he had been sentenced to a prison term of 12 months or more. He remained an independent MEP until his term of office came to an end in June 2009.
